Overview of the Process

The legal process of dissolution in California is designed to end the marriage or domestic partnership and to decide, if necessary, associated issues related to child custody and visitation, spousal and child support, division of debts and assets, and to decide attorneys’ fees and costs.

The overall goal or public policy of California Courts for the dissolution of a marriage or domestic partnership is for such matters to end peacefully and by agreement of the parties. The Courts will actively encourage the parties to resolve their differences by agreement and put in place procedures to facilitate that process (including Alternative Dispute Resolution and Mediation). The terms of a dissolution Judgment can, in fact be reached by agreement between the parties and through negotiation. In this way, the courts invest in the parties a great deal of control over the outcome of their family law matter, should the parties be able to work together.

Unfortunately, an amicable agreement and resolution of issues of spousal support and child custody are not always realistic as many people find that they cannot obtain agreement with their spouse during this emotional and difficult time. Even if you do reach an agreement on any or all issues, you may still need professional representation to ensure that the agreement reached is fair, equitable and properly executed and that all of your rights are protected.
